1. Who you are contracting with
CommitFit (the "Service") is operated by CommitFit, trading as CommitFit ("we", "us", "our"). By creating an account or otherwise using the Service, you are entering into a binding agreement with CommitFit.
2. Acceptance
By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm you are at least 18 years old, or otherwise of legal age in your jurisdiction, and have authority to enter into this agreement.
3. What CommitFit is
CommitFit is a fitness accountability application that provides AI-generated workout plans, food and workout logging, streak tracking, and an optional accountability ("stake") feature that charges a user-defined amount when scheduled workouts are missed.
4. Acceptable use
You must not:
- Use the Service for any unlawful purpose, fraud, or to harass others.
- Send spam or unsolicited communications through the Service.
- Infringe the intellectual property rights of any third party.
- Attempt to interfere with the Service's security, probe or scan it, scrape it, or upload malware.
- Reverse engineer, decompile, or circumvent technical limitations.
- Resell or redistribute the Service without our prior written consent.
5. Account credentials
You are responsible for keeping your credentials confidential and for all activity that happens under your account. You must provide accurate information and keep it updated.
6. Intellectual property
We retain all right, title, and interest in and to the Service, including the software, AI-generated workout templates, documentation, and CommitFit branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms and Paddle's Refund Policy, together with our own Refund Policy.
Subscriptions renew automatically until cancelled. You can cancel at any time via the customer portal accessed from your CommitFit account or via paddle.net.
8. Accountability charges
If you enable the accountability feature and set a non-zero stake amount, you authorise Paddle to charge that amount each time you miss a scheduled workout, subject to any free skips described in the Service. You can lower the stake amount or disable the feature at any time from your account.
9. Service level
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or meet your specific requirements. AI-generated workouts are not medical advice — consult a qualified professional before starting any new training programme.
10. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for fraud, death, or personal injury).
11. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your access ends and your data may be deleted after a reasonable export window.
12. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service, your content, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which CommitFit ordinarily resides. Disputes shall be resolved exclusively in the competent courts of that jurisdiction.
14. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
